A judge has determined patent-holding company Vringo is entitled to additional royalties from Google in a patent infringement case involving Google AdWords.
The order stems from a case brought by Vringo subsidiary I/P Engine in 2011 that claimed filtering technology used in Google AdWords violated two of its patents. A jury found in favor of I/P Engine, awarding it $30,496,155 and running royalty payments of 3.5 percent. The case is I/P Engine Inc. v. AOL Inc., 11cv512.
Google claimed to have updated the AdWords system in May 2013 in such a way that the patents were no longer applicable and said it should not be subject to royalty payments after that point.
In a Memorandum Order issued yesterday, U.S. District Judge Raymond A Jackson disagreed writing, the modified version of AdWords “is nothing more than a colorable variation of the infringing system.” As such Vringo is “entitled to ongoing royalties as long as Defendants continue to use the modified system.”
The 90′s era patents originate from Lycos. Vringo bought the two patents — 6,314,420 entitled “Collaborative/adaptive search engine” and 6,775,664 entitled “Information filter system and method for integrated content-based and collaborative/adaptive feedback queries”– and 6 others in June 2011. It files suit against Google and its customers AOL, Gannett, IAC and Target in September of that year.
Vringo also sued Microsoft in 2013 using the same patents. Microsoft settled with the company.
Matt Kallman, a Google spokesperson told The Washington Post that the “decision further highlights the mischief trolls can make with the patent system.” Google is appealing the ruling.
Google is appealing the original ruling in the Court of Appeals for the Federal Circuit (I/P Engine Inc. v. AOL Inc., 14-1233). Google’s Kallman also said Google will likely be “seeking review of today’s decision as well.”
The excerpts below from the memorandum order provide more background on I/P Engine’s original trial argument regarding AdWords’ process for ad serving and the why the court found that the “new AdWords” of post-May 2013 was essentially the same as the “old AdWords” as it relates to the two patents:
At the trial in this case, I/P Engine’s infringement expert, Dr. Ophir Frieder, testified that old AdWords infringed I/P Engine’s patents at multiple points in the process of selecting which ads would be displayed for a given query. Specifically, this occurred at two so-called “disabling” steps and one “promotion” step, all of which occurred prior to the auction for ad space. Each step used a “predicted click-through  rate,” a quality score based on the combination of content and collaborative data. The selection of ads based on this combination was Dr. Frieder’s central theory of infringement at trial. Ads, however, were not selected based only on this predicted click-through rate; instead, that score formed part of the “long term value,” or LTV score, which included data on the quality of the webpage, the minimum bid, and other factors.  For an ad to proceed to the next step, it was required to have an LTV score greater than zero. The Court has, however, thoroughly reviewed the experts’ descriptions of new AdWords and the ways in which it differs from old AdWords, and is confident that I/P Engine has shown that new AdWords is no more than a colorable variation of old AdWords. Suffice it to say that it is undisputed that new AdWords continues to use a candidate advertisement’s LTV score that includes a predicted click-through rate in the process of choosing which advertisement will ultimately be shown to the individual performing the query.  The only differences between the two systems that are potentially relevant in light of I/P Engine’s theory of infringement at trial is that the LTV score is no longer used at the multiple steps just described, and occurs once at a different point in the process of selecting which advertisements will ultimately be shown to users.
I/P Engine has also proven that new AdWords, like old AdWords, infringes its patents by filtering based on the combination of collaborative and content data.”

Apple Buys Ads On Google & Bing To Celebrate The Mac’s 30th Birthday


Leaving nothing to chance, Apple’s ensured that anyone searching for “Mac” on Google or Bing today, the 30th birthday of the Mac, will know about the anniversary. The company has purchased ads that lead to a special Mac birthday area of the Apple site.
Above is an example of what shows on Google, for a search on “Mac,” an ad saying “Happy Birthday, Mac” and inviting people to “Explore 30 years of innovation on the Mac.” The ad links over to the page at Apple about Macs, which has a pitch for the birthday area:

We here at Yahoo have been ranking the top searches since 2001, our way of providing snapshots into our collective fascinations and fixations from the year. In 2013, quite a few familiar faces return to our annual list of Top 10 Searches, although you wouldn't be blamed for not quite recognizing them. Whether they were coming of age or coming into motherhood, the celebrities who made the list all went through a startling metamorphosis in 2013.
While the 2013 list isn't as news-heavy as last year, when "elections" and "political polls" dominated search terms, people weren't just ogling actors and musicians. Online focus homed in on the Obamacare rollout, a murder trial and — one more time — a smartphone.

Two different digital revolutions make the Top 10 this year. Of course, given the breakneck pace of tech these days, the Apple smartphone isn't as revolutionary but can still be revelatory. The iPhone returns with daunting regularity on Yahoo lists, and the iPhone 5 (No. 9) hit No. 2 last year, even though it wasn't out yet. While the new iteration might not have been a monumental evolution, its GPU prowess proved up to snuff, the new ID access brought biometric technology literally to users' fingertips, and iOS7 design marked a big philosophical break from skeumorphism.
The video block-building game Minecraft (No. 4) has won rapturous praise for being at once simple yet limitless, and for bypassing the long build-up time of other gaming companies. In 2011, the Swedish company's smartphone app leapt to the No. 1 spot in a month, and its beta launch opened to an audience of 16 million registered users. Sales now are above 33 million and growing.
Players — many children — survive attacks by monsters by crafting weapons and creating shelters that become entire worlds. More important, it's a game without rules and without end that has inspired real-world applications, from collaborative school projects to architecture design. Its monumental access has inspired a documentary (recently published on YouTube), a New Yorker profile, and a book about its founder Markus "Notch" Persson.
Trial and error
Despite the battles directed at Affordable Care Act, better known as Obamacare (No. 6), its search average had been moderate until its Oct. 1 launch. With a federal Jan. 1 deadline for all Americans to have health insurance, and the massive (negative) publicity from the shutdown to the national website, people finally went en masse to figure out just "what is obamacare," "affordable health insurance" and what health exchanges were available to them. The intense search surge for the act and site pushed the term into the Top 10.
Not so with Jodi Arias (No. 8), who pulled in searches by mid-December 2012. By the time her trial began on Jan. 2, Arias had confessed to stabbing and shooting her boyfriend, Travis Alexander, in 2008. Livestreaming, social media — including Arias' Twitter updates managed by a friend — and old-fashioned camera-hogging by the prosecutor and Arizona sheriff all contributed to the spectacle. As for why the defendant herself was such a draw, hers was a story that many could relate to (a relationship gone wrong) and yet couldn't understand (a soft-spoken petite woman capable of such brutality).

Celebrity archetypes
Carl Jung had his archetypes, Yahoo has our own — often the pop princess, (Disney) girl next door, celebutante "it" girl, fallen hero, nice Canadian kid — and they can be the same person. Miley Cyrus (No. 1) last made the Yahoo Top 10 when she was 15 and still Disney's No. 1 property as Hannah Montana. Even then, she was catapulting into adulthood with a near-topless Vanity Fair cover shot, although she apologized to fans and declared herself "embarrassed" by those Annie Leibovitz pics.
Five years, a pole dance and several writhing, "Wrecking Ball" music videos later, 21-year-old Cyrus has twerked her way into the No. 1 slot. By the way, that position was occupied by Britney Spears four times — and Cyrus is definitely on Spears' fast-track to dump her clean-cut image. (FYI, the two share the same agent.) Her remarkable transformation didn't happen until mid-year when her music video for "We Can't Stop" came out, complete with debauchery and drug references. She kept fans wondering about her engagement to Liam Hemsworth until September.
Ultimately Cyrus has had the last laugh — in fact, she's been in on the joke the whole time. Her turn as host and musical guest on "Saturday Night Live" got her a return invite two weeks later. Her album "Bangerz" debuted at No. 1 with great sales, leading to the announcement of a huge 2014 tour. And that crying kitty at the AMA Awards has been read as a "screw you" to online critics.

The celebutante famous for being famous stunned entertainment junkies with news she and rapper beau Kanye West were expecting a baby, paving the way for months of stories analyzing how she dressed her baby bump and speculating whether the couple would allow the tot on her family's abundance of shows (for the record, she said no). Unexpectedly, she triggered a white-hot debate about criticism over her pregnancy weight gain — and it didn't help she was being compared to the "ideal" maternity style of the Duchess of Cambridge.
After Kardashian gave birth on June 15, people moved on to debating the baby's name (and what an interesting name North West is), and when the social media-savvy Kardashian would share baby's first photo — although it was her postpartum slimmed-down selfie that got the attention. There was plenty of on- and off-camera drama with her family, with rumored marital problems between Khloé and Lamar Odom as well as Kris and Bruce Jenner's split. That didn't deter West's elaborate marriage proposal — less than five months after Kardashian's divorce from Kris Humphries was finalized — in a San Francisco baseball stadium. No wedding date yet, but expect it to keep Kardashian in our lives well past 2014.
Justin Bieber (No. 10) was another awkward coming-of-age story. Like Cyrus, the young pop singer returned to our Top 10 after a two-year absence, but perhaps for all of the wrong reasons. The year started out with his huge breakup from girlfriend Selena Gomez (No. 5), and seemed to go downhill from there. Gossip focused more on his crazy shenanigans than for his music, despite the success of his worldwide Believe Tour. Major car problems, nightclub fights (on both sides of the pond), peeing in a mop bucket while cursing out a president, a confiscated monkey — Bieber just couldn't seem to make a good decision to save his life this year.
Being single turned out fine for Gomez (the exes still hang out). Her lead single "Come & Get It" hit double platinum, and her video got Gomez a MTV VMA Moonman. Her movie "Getaway" though didn't win any distinctions, unless you count one of the year's worst reviewed films on Rotten Tomatoes. (Hey, there's always "Spring Breakers" on Amazon Prime.)
This year was also very good for Kate Upton, who went from supermodel to bona fide international celebrity. The sexpot, who turned 21, had a few tabloid romances, starting with Detroit Tigers pitcher Justin Verlander and settling in with "Dancing With the Stars" pro Maksim Chmerkovskiy. Career-wise, she nabbed her first big screen role in "The Other Woman" (2014), playing opposite A-listers Cameron Diaz and Leslie Mann.
She's unlikely to give up her day job anytime soon. In 2013 she booked ad campaigns for David Yurman and Carl's Jr. and starred in a successful Super Bowl commercial for Mercedes-Benz. After she graced Sports Illustrated's Swimsuit Issue cover for the second time in as many years, Vogue called her The Hottest Supermodel on Earth and the fashion world crowned her 2013 Model of the Year. All of this on top of appearing on almost every magazine cover in print — even Golf Digest.
Amanda Bynes appears in court in NYC facing charges of reckless endangerment, tampering …The most potent celebrity story though might be Amanda Bynes (No. 7). The 27-year-old actress is reportedly suffering from schizophrenia and bipolar disorder; the illness often manifests itself in females when they reach their mid- to late 20s. At first, her bizarre sightings and even more bizarre Twitter attacks on other celebrities played out like another former child star losing it, reminiscent of Spears' breakdown in 2007 and Mischa Barton's in 2009. Things got more serious in May when Bynes was arrested on three misdemeanor counts. In July, she was taken into an involuntary mental health hold after trying to light a fire in a neighbor's driveway. Her parents filed for — and were granted — conservatorship over their daughter. Bynes moved to a rehab facility in late September. In a twist, a ruling that she can stand trial for a 2012 DUI case is actually good news, as she was deemed mentally competent. Unconfirmed reports speculated that she could be released in time for Christmas.

Google Keep
Google Keep is designed for quick, short notes
— everything looks like a little Post-it, but you
can do a lot in those little boxes. To-do lists,
location reminders, and fast searching make it
feel full-featured without bogging you down.
Pocket
There are two big, popular "read it later" apps:
Instapaper and Pocket. On Android, at least,
Pocket gets the nod for more frequent updates
and support for video. Articles are synced
automatically and saved offline, with options to
adjust the layout to your liking.
Snapseed
As a photo editor, Snapseed moves well
beyond basic filters into the kinds of changes
usually reserved for the desktop. With a set of
simple tools the app makes even complex
photo adjustments understandable and
accessible.
Dropbox
Dropbox makes it easy to access your files
from your phone. But there's another use that
might interest you even if you don't think you
need it: the service is great for simply getting
files from your computer to your phone without
a cable.
Slice
Slice is a super-clever service that
automatically watches your inbox for emails
from big-name merchants and shipping
companies. Why would you risk giving that
access? To get automated package tracking,
deal alerts, and price-drop notices. So useful,
it's creepy.
Nova and Apex Launcher
All too often the stock home screens on
Android phones are terrible. Nova Launcher
and Apex Launcher both make it better, with
cleaner designs and plenty of customization
and theming options. You can pony up for
premium versions that offer more features, too.
Google Play Music
Google Play Music is probably already
preloaded on your phone, but if you haven't
tapped in and looked around recently, you
really should. In the past year Google has
added free and paid streaming options and
improved the interface dramatically. The result
is probably the best music app for Android
users.
Netflix
Netflix is another app that you probably don't
give a second thought to, but it's made great
strides on Android in the past year. Support for
Chromecast means that even if you don't watch
TV on your phone, it's worth the install.
VSCOcam
A longtime favorite on the iPhone, VSCO Cam
is finally available on Android and it works
really well. You’ll get photo filters that aren’t
as heavy-handed as Instagram’s along with the
ability to quickly revert the image if you don’t
like how it turned out.
Press
RSS may not be as popular as it once was, but
if you're still addicted to your news feeds,
Press is the best option on Android . Instead of
Flipboard's image-heavy layout, you just get a
well-designed list of headlines and articles.
Sometimes that's all you need.
Simplenote
After years of using third-party apps for
syncing notes, an official Simplenote app
finally came out on Android this year. It has a
barebones design that lets you focus on what
Simplenote does best: rapidly entering in and
searching for your own words.

Global food index: India ranks among the worst on food accessibility

NEW DELHI: India figured among 30 countries at the bottom when 125 countries where ranked according to the global food index, which included levels of undernutrition, food prices, quality of food and unhealthy outcomes due to people's diet. The pile at the bottom comprised mostly African countries along with India, Pakistan, Bangladesh and Laos from Asia.

The global food index was compiled by Oxfam, an international aid and charity organisation working to alleviate poverty and hunger. It combined data most recently available from eight global data sources including the World Health Organisation, the Food and Agriculture Organisation and the International Labour Organisation.

While India and Pakistan figured 29 and 28 from the bottom with a food index ranking of 97, Bangladesh figured 24 from the bottom with a ranking of 102 and Laos ranked 112.

The top ten ranks were grabbed by European countries with Netherlands being ranked the best followed by France, Switzerland, Denmark, Sweden and Austria in that order. In fact the top 20 spots were all from Western Europe barring Australia which figures at the 12th place. The UK was at the 16th place, the US rank was 21 and Brazil ranked 25 on the list along with Canada. Chad Angola and Ethiopia rank the worst in the overall food index ranking.

India again figured at the bottom along with countries like Burundi, Yemen, Eritrea, Madagascar and Timor Leste for having the highest rates of undernutrition and highest proportion of underweight children. In this list India has no company from Asia.

When it comes to affordability and quality of food India is not that badly off. It is when it comes to the measure of people having enough to eat that India sinks to the bottom showing how food distribution and accessibility to food are huge problems especially for the country's poor. The US scores high on both affordability as well as quality. But the cheap food available is not always of very good quality as it evident from the high rate of obesity and diabetes in the country. Saudi Arabia has the highest rate of obesity. The US along with Mexico, Kuwait, Jordan, Czech Republic and Fiji are at the bottom of the pile showing very high prevalence of diabetes and obesity.

Around the world one in eight people go to bed hungry every night despite there being enough food for everyone. About 900million people still don't have enough to eat, and 1 billion people are obese pointed out Oxfam showing how skewed the global food distribution system was.

Oxfam suggested immediate steps to tackle climate change impact on food production, to stop the diversion of crops from food to biofuel, to put curbs on food industry to address obesity and diabetes, to address unfair trade agreements that affect food availability and more investment in infrastructure for storage and transportation of food.
